Getting EAD
To work with a L2 Visa, you still require an EAD.
Forget the post "Getting the SSN with L2 Visa": I called DHS and their answer was clear. No EAD, no right to work!
You have 2 solutions to apply: either e-filling or mailing.
I personnally would recommend the e-filling since USCIS took more than 4 working days before acknowledging reception of my form. So applying online would save you a few days.
To apply online, I believe (as I said, I did not do it this way) that you must create an account, then you will require:
- a debit or credit card (visa type) if you apply online, a cashier check if you apply by mail (To get a cashier check, you can go to any bank and pay the amount of the check + bank commission). The amount of the fee was $340 for me, but it may have changed, so you had better check on USCIS web site. The beneficary is the U.S. Department of Homeland Security.
- a copy of your I-94
- a copy of your spouse I-94 (not sure, but might be required)
- a copy of your passport showing your picture, name and date of birth
- 2 identical color photograph (american format, as for Visa)
- your form I-765
Once you have all these documents, you just have to mail it to USCIS. If you apply in California, the address is:
California Service Center

(If you apply online, you should have more information about the documents to send while filling the form)
A few days after mailing, you should receive and acknowledgment form USCIS. This will enable you to follow the status of your case online (or by phone) using the provided code.
A few weeks after applying, you should receive an appointment from USCIS to have your fingerprint taken.
NB: After 2 months I still had not received any appointment from USCIS so I decided to call them, even if their phone message said you should not contact them before the end of their processing time. The result is that I got my card 4 days after calling them (and my card says "fingerprint not available", but who cares?).
SSN received!
Not that I pretend that the way we did it is the best but after no more than 11 days, the SSN was in the P.O. Box.

Getting SSN
Once you are in the USA, the first thing to do is to get your SSN : without SSN, you cannot get a debit card nor a checks, you cannot rent an apartment, you cannot get your driving license, etc...
To do that, it's very easy. Here is the way we manage to get our SSNs in only 10 days.
Remember that both L1 visa holder AND L2 visa holder can get SSN (without having EAD for L2 visa holder).
1st Step
Open a P.O. Box. To receive your SSN, you have to give an address.
To open a P.O. Box, just go any Post Office. The price is $35 for 6 months.
2nd Step
Go to any Social Security Agency. We were told that it's better to wait for your DHS registration before applying for SSN (the process is supposed to be faster). We personally applied 4 days after arrival.
To know if you are registered, you can simply ask a SSA agent to perform the check.
Note that you can apply for SSN from any SS agency. So if you to go on hollidays, go on! Just find hotels close to SSA ;)
3rd Step
Get you SSN.
You're done!

Finding an accomodation
First thing is to ask the right questions: Staying for a few nights or staying for long time (the time to get SSN and to find an appartment) ?
- Whether it's the second choice, you might prefer to go to an extended stay hotel. Rate is about 25% higher than motels but you will have a much larger room with a kitchen. Best choice seems to be studio 6 (same company as motel 6, belonging to ACCOR group) but it is only available in a few states.
- When staying a few nights, the cheaper are motels (excepted youth hostels) and don't believe there are always situated along freeways! You have a large choice but motel 6 and super 8 seems to be the most famous.

La retraite
Si vous souscrivez à la couverture retraite de votre employeur aux Etats-Unis, les trimestres effectués aux USA seront comptabilisés pour le calcul de votre durée de cotisation en France.
Votre salaire n’entrera en compte dans le calcul de votre retraite que si vous souscrivez à la CFE, mais apparemment ça ne vaut pas le coup pour deux ans aux USA.
La couverture santé
Ma situation :
- je quitte le territoire français le 3 décembre 2007
- mon contrat de travail français se termine le 30 décembre 2007
- mon contrat américain commence le 31 décembre 2007
Sécurité Sociale (hors CFE)
A partir de la date de début de votre contrat américain, vous ne dépendrez plus du système de sécurité sociale.
Entre
le moment où vous partez de France et le moment où votre contrat de
travail français se termine, et pour les personnes de votre
entourage qui souhaitent vous rendre visite, la situation est
différente.
En effet, vous
allez dans un pays qui ne possède pas de convention
particulière avec
la France.
La
situation que vous évoquez est régie par l'article L 332.3 du Code de
la
Sécurité Sociale qui stipule que : "sous réserves des conventions et
règlements internationaux et de l'article L766-1, lorsque les soins
dispensés
hors de France aux assurés et à leurs ayants droit les prestations
correspondantes des assurances maladie et maternité ne sont pas servies."
Le
fait qu'il n'existe aucune convention de Sécurité Sociale - entre le
pays qui
vous va vous accueillir et la France - libère la CPAM de toute
obligation de
prise en charge des soins que vous seriez amené à recevoir dans un tel
contexte.
Toutefois,
l'article R332.2.1 du code de la Sécurité Sociale assouplit quelque peu
cette
règle en introduisant une faculté de prise en charge. Mais il
convient
de
souligner cette disposition comme aléatoire.
Dans
cette perspective, je vous remercie donc de conserver tous les
justificatifs
nécessaires (factures, etc.) et vous nous contacterez dès votre retour
pour que
nous puissions vous faire parvenir l'imprimé correspondant. Le dossier
sera
ensuite étudié par le service compétent.

Par ailleurs, vu que vous quittez le territoire français, vous devrez adresser à votre CPAM un courrier indiquant votre date de départ ainsi que le pays de destination, accompagné de votre carte vitale.

- Rembourse consultation, hospitalisation, médicaments, même si cela n’entraîne pas de rapatriement
- Rembourse jusqu’à 155 000 euros en complément des remboursements de la sécurité sociale française avec une franchise de 50 euros
- Avant toute consultation, hospitalisation, achat de médicaments, il faut contacter Visa Premier pour accord préalable (sauf urgence évidemment)
- Si on ne possède pas de couverture de sécurité sociale en France, on n’est pas couvert par Premier Assistance :
l’entreprise d’accueil doit assurer la personne entre l’arrivée sur le
sol américain et le début du contrat de travail ou la personne doit
souscrire à une assurance privée.

Getting the SSN with L2 Visa
It seems many L2 Visa holder do not to know that SSN can be got with just a simple I-94, a passport and a translated marriage certificate. That's why I'm posting this message !
A SSA internal paper was issued on 19/10/2007 explaining that L2 visa holder no more need to have an EAD to get SSN. (see section C.1 in RM 00203.500). Thanks to this, you won't have to wait months before getting your driving license and banking account!
However, I have read that SSA agents do not always know the existence of this paper. So it might be a good idea to bring a copy with you when going to Social Security Office.
Only question is: I don't know if this SSN allows you to work or if you still have to go through the long DHS process to get work authorization...
